Equal treatment
The principle of equal treatment is a fundamental concept that stipulates that all people should be treated fairly and without discrimination, based on objective criteria. It is based on the idea that individuals in comparable situations should enjoy the same rights and benefits, which is essential to ensure fairness in various contexts. In the world of work, equal treatment means giving employees similar benefits and the same remuneration in an identical situation. This general principle is reflected in the adage "equal pay for equal work".(Cass, soc, October 29 1996, n°92-43.680)
The law also provides a framework for more specific situations such as :
- Equal treatment of employees on permanent and fixed-term contracts(article L. 1242-14 of the French Labor Code)
- Equal treatment for full-time and part-time employees(article L. 3123-5 of the French Labor Code)
- Equal pay for men and women(article L. 3221-2 of the French Labor Code)
