MAJ 3/12/2022 : The purpose of these internal rules is to specify certain provisions applying to all participants in the various training courses organized by the training organization, in order to ensure the smooth running of the courses offered.
Preamble
The purpose of these rules and regulations is to specify certain provisions applying to all registrants and participants in the various training courses organized by the training organization, with the aim of ensuring the smooth running of the training courses offered.Definitions: the training organization will hereinafter be referred to as the "training organization", the persons enrolled in a training course will hereinafter be referred to as the "participants", the training director at the training organization will hereinafter be referred to as the "training organization manager".
General Provisions
Article 1
In accordance with Articles L6352-3, L6352-4 and R 6352-1 to R6352-15 of the French Labor Code, the purpose of these Internal Rules is to define the general and permanent rules and to specify the health and safety regulations, as well as the rules relating to discipline, in particular the sanctions applicable to participants and their rights in the event of a sanction.
Fields of application
Article 2
The present regulations apply to all participants enrolled in a session provided by the training organization, for the entire duration of the training course. Each trainee is deemed to have accepted the terms of the present regulations when following a training course provided by the training organization, and accepts that measures will be taken against him/her in the event of non-compliance.
Article 3 - Training location
Training takes place either on the premises of the training organization, or on external premises. The provisions of the present regulations are applicable within the training organization's premises and in any areas ancillary to the organization (classrooms and sites visited, etc.) throughout the duration of the training. However, in accordance with article R 6352-1 of the French Labor Code, when training takes place in a company or establishment that already has internal regulations, the health and safety measures applicable to participants are those of the latter regulations. When the training is provided remotely, the present regulations do not apply.
Health and safety
Article 4 - General rules
Preventing the risk of accidents and illness is imperative, and requires full compliance with all applicable health and safety regulations. To this end, all trainees must ensure their own personal safety and that of others, by complying with the general and specific safety instructions in force within the organization and on the training site. They must be strictly adhered to, failing which disciplinary action will be taken.
Article 5 - Alcoholic beverages
It is forbidden for participants to enter or remain on the premises in a state of intoxication, or to bring in alcoholic beverages.
Article 6 - No smoking or vaping
In application of decree no. 2006-1386 of November 15, 2006 setting out the conditions for implementing the ban on smoking and vaping in places designated for collective use, smoking and vaping are prohibited on training premises.Code de la santé publique: article L3513-6 and Arrêté du 3 janvier 2007 relatif à la signalisation de l'interdiction de fumer dans les lieux publics (Decree of January 3, 2007 on signs prohibiting smoking in public places).
Article 7 - Fire instructions
In accordance with articles R 4227-28 to R 4227-33 of the French Labor Code, fire instructions, including a map showing the location of fire extinguishers and emergency exits, are posted on the training premises so that all participants are aware of them.
Article 8 - Accident
Any accident or incident occurring on the occasion of or during training must be reported immediately by the trainee involved, or those who witnessed the accident, to the organization's manager.
Discipline
Article 9 - Dress and behaviour
Participants are asked to arrive at the training venue in decent dress, to respect the operating rules announced at the start of the training and to behave correctly towards everyone in the organization.
Article 10 - Training times
Training timetables are set by the training organization and brought to the attention of participants either by the electronic invitation to attend, or when the training program is handed out to participants. Participants are required to respect these schedules. The training organization reserves the right, within the limits imposed by the provisions in force, to modify training schedules according to service requirements.
Article 11 - Access to the training site
Unless expressly authorized by the training organization, participants who have access to the training site for training purposes may not: enter or remain there for other purposes and/or facilitate the introduction of third parties to the organization.
Article 12 - Use of equipment
Each trainee is obliged to keep the equipment entrusted to him/her for training purposes in good condition. Participants are required to use the equipment in accordance with its purpose. The use of equipment for other purposes, in particular personal use, is forbidden, except for equipment made available for this purpose. At the end of the training course, trainees are required to return all equipment and documents in their possession belonging to the training organization, with the exception of educational documents distributed during the course.
Article 13 - Recordings
It is strictly forbidden to film or record training sessions, unless expressly authorized.
Article 14 - Educational documentation
The educational documentation provided during training sessions is protected by copyright and may not be reused other than for strictly personal use.
Article 15 - Theft or damage to participants' personal property
The training organization declines all responsibility for loss, theft or damage to personal items of any kind left by participants on the training premises.
Article 16 - Penalties

Any failure by the trainee to comply with any of the provisions of these Internal Regulations may result in a sanction. In accordance with article R 6352-3 of the French Labor Code, a sanction is any measure, other than verbal observations, taken by the head of the training organization or his or her representative, following an action by the trainee which he or she considers to be at fault, whether or not this measure is likely to immediately affect the trainee's presence in the training program, or to jeopardize the continuity of the training he or she receives. Depending on the seriousness of the breach, the sanction may take the form of a warning, reprimand or permanent exclusion. Fines or other financial penalties are prohibited.

The head of the training organization must inform the following of the sanction taken: the employer, if the trainee is an employee benefiting from training as part of the company's training plan; the employer and the parity organization which has covered the training expenses, if the trainee is an employee benefiting from training as part of a training leave program.

Article 17 - Disciplinary proceedings
No sanction may be imposed on a trainee without the latter having first been informed of the grievances against him/her. When the head of the training organization or his or her representative is considering imposing a sanction which may or may not have an immediate impact on a trainee's attendance at a training course, the procedure is as follows: the head of the training organization or his or her representative summons the trainee and informs him or her of the purpose of the summons. The notice specifies the date, time and place of the interview. It is written and sent by e-mail or handed to the trainee against a receipt. During the interview, the trainee may be assisted by a person of his/her choice, whether a trainee or an employee of the training organization. The summons referred to in the previous paragraph shall mention this option. The head of the training organization or his or her representative will state the reason for the proposed sanction and will hear the trainee's explanations. The penalty may not be imposed less than one clear day or more than fifteen days after the interview. The trainee is notified of the decision in writing, with reasons, by e-mail, and receives a receipt. When the offence has given rise to a temporary exclusion with immediate effect, no definitive sanction relating to this offence may be taken without the trainee having first been informed of the grievances against him/her and, where applicable, having followed the procedure described above.
Article 18 - Trainee representation
When the duration of a training course exceeds 500 hours, a titular delegate and a substitute delegate are elected in a two-round uninominal ballot. All trainees are eligible to vote, with the exception of prisoners admitted to vocational training.The training organization organizes the ballot, which takes place during training hours, no earlier than 20 hours and no later than 40 hours after the start of the course. If it is not possible to appoint trainee representatives, the training organization draws up a "procès-verbal de carence", which it forwards to the regional prefect with territorial jurisdiction.Delegates are elected for the duration of the training course. Their functions end when they cease, for whatever reason, to take part in the training.If the titular delegate and alternate delegate cease to hold office before the end of the training session, a new election is held in accordance with the conditions laid down in articles R.6352-9 to R.6352-12.Trainees' representatives make all suggestions for improving the running of training courses and trainees' living conditions in the training organization. They present all individual or collective complaints relating to these matters, to health and safety conditions and to the application of internal regulations.
Article 19
These rules are given to each trainee in paper and/or electronic form.
Article 20
A copy of these regulations is available on request.
